Terms and Conditions

Please read these Terms and Conditions ("Terms", "Terms and Conditions") carefully before using the DeckHunter mobile application (the "App") operated by Linking Lotus Ltd ("us", "we", or "our").

Your access to and use of the App is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the App. By accessing or using the App, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the App.

1. Accounts

1.1. Account Creation

To access certain features of the App, you must register for an account. When creating an account, you will be required to provide your email address, create a password, and choose a unique username. Your username does not need to be your real name.

1.2. Account Security

You are responsible for safeguarding the password that you use to access the App and for any activities or actions under your password. We enforce certain password criteria to help you create a strong password. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorised use of your account. You are solely responsible for all activities that occur under your account.

1.3. Account Types

DeckHunter offers a free version with certain features available to all users. Access to additional premium features requires a paid subscription. We may offer a 30-day free trial for new users to experience premium features before a subscription is charged.

1.4. Account Deletion

You can delete your DeckHunter account at any time through the settings menu within the App. Upon confirming your intention to delete your account (which will require re-entering your password for verification), all personal data associated with your account will be permanently and irreversibly removed.

1.5. Subscription Cancellation

Please be aware that deleting your DeckHunter account does not automatically cancel your subscription. You are solely responsible for managing and cancelling your subscription directly through the Google Play Store or Apple App Store, in accordance with their respective policies. We recommend cancelling your subscription before deleting your account to avoid future charges.

2. App Usage and Functionality

2.1. Core Features

DeckHunter provides tools for managing your Trading Card Game (TCG) collection, building decks, viewing card prices, and facilitating connections with other players for trading purposes. Key functionalities include collection management, deck building, displaying card prices, identifying users with cards for trade, and managing your personal trade binder.

2.2. User Provided Content (Trade Features)

To facilitate trading, you have the option to provide your Instagram or Discord handle and your general area (country, county, city) for display to other users within the App when you list cards in your trade binder. By providing this information and placing cards in your trade binder, you acknowledge and agree that this information will be publicly visible to other DeckHunter users for the sole purpose of enabling contact outside the App for trading discussions. DeckHunter does not provide any in-app messaging or direct contact functionality.

2.3. No User-Generated Content (UGC)

Users are not able to upload their own content, such as photos of cards, custom comments, or forum posts, directly to the App.

2.4. Third-Party Content and Services

• DeckHunter displays card prices which are pulled on a daily basis from third-party sources, namely TCGplayer and Cardmarket. The App will display the last update date and time for these prices, and users can switch between seeing prices from Cardmarket and TCGplayer in the settings.
• Disclaimer on Prices. While we strive to provide timely information, Linking Lotus Ltd is not responsible for the accuracy, completeness, or timeliness of prices or other information provided by TCGplayer, Cardmarket, or any other third-party data sources. Prices are for informational purposes only and are subject to change without notice. DeckHunter does not guarantee that displayed prices will always reflect the current market value.
• We may also link to third-party websites or services. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services.

3. Intellectual Property

3.1. DeckHunter Intellectual Property

The App, its original content (excluding third-party content), features, and functionality are and will remain the exclusive property of Linking Lotus Ltd and its licensors. The DeckHunter name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Linking Lotus Ltd or its affiliates or licensors. You must not use such marks without the prior written permission of Linking Lotus Ltd.

3.2. Third-Party Intellectual Property (TCG Content)

DeckHunter is a fan-made application and is not an official application of, nor is it affiliated with, endorsed, or supported by, Bandai Co., Ltd. or any other Trading Card Game publishers. Images, illustrations, card information, and other intellectual property related to specific TCGs (e.g., One Piece TCG, Gundam TCG, Riftbound TCG, Palworld TCG) used within the App are the property of their respective authors and copyright holders. Our use of such content is for informational and educational purposes within the context of a collection management and deck-building tool for fans. All trademarks and copyrights belong to their respective owners.

3.3. Copyright Infringement

If you believe that any content in the App infringes upon your copyright, please contact us at Support@deckhunter.app with a detailed description of the alleged infringement.

4. Purchases and Subscriptions

4.1. Subscription Model

DeckHunter offers premium features through a monthly or yearly subscription. Subscriptions are processed and managed by Google Play Store (for Android devices) and Apple App Store (for iOS devices).

4.2. Payment Processing

All payments, billing, and subscription management are handled directly by Google Play Store and Apple App Store in accordance with their terms of service and payment policies. Linking Lotus Ltd does not directly process or store your payment information.

4.3. Refunds

Your refund rights for subscriptions are governed by the respective policies of the Google Play Store and Apple App Store:

4.4. Price Changes

Subscription prices are subject to change. Any price change will apply to your next billing cycle and will not affect your current subscription period. We will provide you with reasonable prior notice (at least 15 days) of any price changes by notifying you within the App and/or on our website.

5. Disclaimers

5.1. "As Is" and "As Available" Basis

Your use of the App is at your sole risk. The App is provided on an "AS IS" and "AS AVAILABLE" basis. Linking Lotus Ltd expressly disclaims all warranties of any kind, whether express or implied.

5.2. No Warranties

Linking Lotus Ltd, its subsidiaries, affiliates, and its licensors do not warrant that:

• the App will function uninterrupted, securely, or be available at any particular time or location;
• any errors or defects will be corrected;
• the App is free of viruses or other harmful components; or
• the results of using the App will meet your requirements or be accurate or reliable.

6. Limitation of Liability

In no event shall Linking Lotus Ltd, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses.

7. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms, engage in illegal activity, or fail to make timely subscription payments.

You may terminate your account at any time by following the account deletion process described in Section 1.4. You may also cease your subscription auto-renewal at any time through the Google Play Store or Apple App Store.

8. Governing Law and Dispute Resolution

These Terms shall be governed and construed in accordance with the laws of Ireland, without regard to its conflict-of-law provisions. We encourage you to contact us directly at Support@deckhunter.app to seek a resolution for any issues. Any dispute that cannot be resolved informally shall be subject to the exclusive jurisdiction of the courts of Ireland.

9. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 15 days' notice prior to any new terms taking effect.

10. Miscellaneous

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between you and Linking Lotus Ltd regarding our App.
